1. शर्तों की स्वीकृति / Acceptance of Terms

इस ऑनलाइन लॉटरी एवं आवंटन पोर्टल ("पोर्टल") का उपयोग करके, आप इन नियमों एवं शर्तों ("शर्तें") से बाध्य होने के लिए सहमत होते हैं। यदि आप इन शर्तों से सहमत नहीं हैं, तो कृपया इस पोर्टल का उपयोग न करें।

By accessing and using this Online Lottery & Allotment Portal ("Portal"), you agree to be bound by these Terms & Conditions ("Terms"). If you do not agree with these Terms, please do not use this Portal.

ये शर्तें राजस्थान आबकारी अधिनियम, 1950 और राजस्थान आबकारी नियम, 1956 तथा समय-समय पर जारी किए गए संशोधनों और आदेशों के अनुसार हैं। इन शर्तों और किसी भी वैधानिक प्रावधान के बीच विसंगति की स्थिति में, वैधानिक प्रावधान प्रभावी होंगे।

These Terms are in accordance with the Rajasthan Excise Act, 1950 and the Rajasthan Excise Rules, 1956 along with amendments and orders issued from time to time. In the event of any inconsistency between these Terms and any statutory provision, the statutory provision shall prevail.

2. पोर्टल का उपयोग / Portal Usage

यह पोर्टल विशेष रूप से निम्नलिखित वैध उद्देश्यों के लिए डिज़ाइन किया गया है:

This Portal is designed exclusively for the following legitimate purposes:

• आबकारी लाइसेंस के लिए ऑनलाइन आवेदन प्रस्तुत करना। Submitting online applications for excise licenses.
• कम्प्यूटरीकृत लॉटरी प्रक्रिया में भाग लेना। Participating in the computerized lottery process.
• लॉटरी परिणाम और आवंटन सूचियाँ देखना। Viewing lottery results and allotment lists.
• आवेदन शुल्क और लाइसेंस शुल्क का भुगतान करना। Making payment of application fees and license fees.
• विभागीय सूचनाएँ, आदेश और अधिसूचनाएँ देखना। Viewing departmental notices, orders, and notifications.

पोर्टल का उपयोग किसी भी अवैध, अनधिकृत या भ्रामक उद्देश्य के लिए करना सख्त वर्जित है। ऐसा करने पर विधिक कार्रवाई की जा सकती है।

Use of the Portal for any illegal, unauthorized, or fraudulent purpose is strictly prohibited. Such use may result in legal action.

3. उपयोगकर्ता की जिम्मेदारियाँ / User Responsibilities

पोर्टल के उपयोगकर्ता के रूप में, आप निम्नलिखित के लिए जिम्मेदार हैं:

As a user of the Portal, you are responsible for the following:

• सटीक जानकारी / Accurate Information: आवेदन पत्र में प्रदान की गई सभी जानकारी सत्य, पूर्ण और सटीक होनी चाहिए। गलत या भ्रामक जानकारी देने पर आवेदन निरस्त किया जा सकता है और विधिक कार्रवाई की जा सकती है। All information provided in the application form must be true, complete, and accurate. Providing false or misleading information may result in cancellation of the application and legal action.
• वैध दस्तावेज / Valid Documents: अपलोड किए गए सभी दस्तावेज मूल, वैध और सत्यापन योग्य होने चाहिए। जाली या परिवर्तित दस्तावेज प्रस्तुत करना दंडनीय अपराध है। All uploaded documents must be original, valid, and verifiable. Submitting forged or altered documents is a punishable offence.
• समयबद्ध भुगतान / Timely Payment: निर्धारित शुल्कों का भुगतान अंतिम तिथि से पहले किया जाना चाहिए। देय तिथि के बाद भुगतान स्वीकार नहीं किया जाएगा और आवंटन रद्द हो सकता है। Payment of prescribed fees must be made before the due date. Payments after the due date will not be accepted and allotment may stand cancelled.
• खाता सुरक्षा / Account Security: अपने लॉगिन क्रेडेंशियल्स (यूजरनेम, पासवर्ड, ओटीपी) की गोपनीयता बनाए रखना आपकी जिम्मेदारी है। आपके खाते के माध्यम से की गई सभी गतिविधियों के लिए आप उत्तरदायी होंगे। Maintaining the confidentiality of your login credentials (username, password, OTP) is your responsibility. You will be liable for all activities conducted through your account.

4. आवेदन प्रक्रिया / Application Process

आबकारी लाइसेंस हेतु आवेदन प्रक्रिया के संबंध में निम्नलिखित शर्तें लागू होती हैं:

The following conditions apply regarding the application process for excise licenses:

• एक बार आवेदन प्रस्तुत करने के बाद, वह बाध्यकारी (binding) माना जाएगा। आवेदक निर्धारित अवधि के भीतर ही आवेदन में संशोधन कर सकता है। Once an application is submitted, it shall be considered binding. The applicant may modify the application only within the prescribed period.
• अंतिम प्रस्तुति के बाद आवेदन स्वतः लॉक हो जाएगा और इसमें कोई परिवर्तन संभव नहीं होगा। After final submission, the application will be automatically locked and no modifications will be possible.
• एक आवेदक एक श्रेणी के लिए एक ही जिले में केवल एक आवेदन प्रस्तुत कर सकता है। एक से अधिक आवेदन पाए जाने पर सभी आवेदन निरस्त किए जा सकते हैं। An applicant may submit only one application per category per district. If multiple applications are found, all applications may be cancelled.
• आवेदन प्रस्तुत करना किसी भी प्रकार के लाइसेंस या आवंटन की गारंटी नहीं है। Submission of an application does not guarantee any license or allotment.

5. शुल्क और भुगतान / Fee and Payment

शुल्क और भुगतान के संबंध में निम्नलिखित शर्तें लागू होती हैं:

The following terms apply regarding fees and payments:

• आवेदन शुल्क / Application Fee: आवेदन शुल्क अप्रतिदेय (non-refundable) है। किसी भी परिस्थिति में — चाहे आवेदन स्वीकार हो या अस्वीकार — आवेदन शुल्क वापस नहीं किया जाएगा। The application fee is non-refundable. Under no circumstances — whether the application is accepted or rejected — will the application fee be refunded.
• भुगतान गेटवे / Payment Gateway: भुगतान ऑनलाइन भुगतान गेटवे के माध्यम से किया जाता है। भुगतान गेटवे अपनी स्वतंत्र शर्तों और नीतियों के अधीन संचालित होता है। तकनीकी समस्या के कारण डबल भुगतान होने पर धनवापसी भुगतान गेटवे की नीति के अनुसार प्रसंस्कृत की जाएगी। Payments are made through an online payment gateway. The payment gateway operates under its own independent terms and policies. In case of double payment due to technical issues, refunds will be processed as per the payment gateway's policy.
• लाइसेंस शुल्क / License Fee: लॉटरी में सफल होने पर, निर्धारित लाइसेंस शुल्क और अन्य वैधानिक शुल्कों का भुगतान निर्दिष्ट समय-सीमा के भीतर किया जाना अनिवार्य है। Upon successful selection in the lottery, payment of prescribed license fee and other statutory charges is mandatory within the specified timeline.

6. लॉटरी प्रक्रिया / Lottery Process

आबकारी लाइसेंस के लिए लॉटरी प्रक्रिया के संबंध में निम्नलिखित शर्तें लागू होती हैं:

The following terms apply regarding the lottery process for excise licenses:

• कम्प्यूटरीकृत चयन / Computerized Selection: लॉटरी पूर्णतः कम्प्यूटरीकृत, यादृच्छिक (random) चयन प्रक्रिया के माध्यम से संचालित होती है। The lottery is conducted through a fully computerized, random selection process.
• पारदर्शिता / Transparency: लॉटरी ड्रा अधिकृत अधिकारियों की उपस्थिति में आयोजित किया जाता है और इसकी वीडियोग्राफी की जाती है। The lottery draw is conducted in the presence of authorized officials and is videographed.
• अंतिम और बाध्यकारी / Final and Binding: लॉटरी के परिणाम अंतिम और बाध्यकारी हैं। लॉटरी परिणामों के विरुद्ध कोई अपील या पुनर्विचार याचिका स्वीकार नहीं की जाएगी, सिवाय उन मामलों के जहाँ तकनीकी त्रुटि प्रमाणित हो। The results of the lottery are final and binding. No appeal or review petition against lottery results will be entertained, except in cases where a technical error is established.
• प्रतीक्षा सूची / Waiting List: लॉटरी में एक प्रतीक्षा सूची भी तैयार की जाती है। मूल चयनित आवेदक द्वारा आवंटन स्वीकार न करने पर, प्रतीक्षा सूची के क्रम के अनुसार अगले आवेदक को अवसर दिया जाएगा। A waiting list is also prepared in the lottery. If the originally selected applicant does not accept the allotment, the next applicant in the waiting list order will be offered the opportunity.

7. आवंटन की शर्तें / Allotment Terms

लॉटरी में सफल आवेदकों के लिए निम्नलिखित आवंटन शर्तें लागू होती हैं:

The following allotment terms apply to applicants successful in the lottery:

• स्वीकृति / Acceptance: चयनित आवेदक को लॉटरी परिणाम घोषित होने के 15 कार्यदिवसों के भीतर आवंटन स्वीकार करना होगा, अन्यथा आवंटन स्वतः रद्द हो जाएगा। The selected applicant must accept the allotment within 15 working days of the lottery result declaration, failing which the allotment will be automatically cancelled.
• लाइसेंस शुल्क भुगतान / License Fee Payment: आवंटन स्वीकार करने के बाद, निर्धारित लाइसेंस शुल्क का भुगतान 30 दिनों के भीतर करना अनिवार्य है। After accepting the allotment, payment of the prescribed license fee must be made within 30 days.
• दस्तावेज सत्यापन / Document Verification: आवंटन के बाद, मूल दस्तावेजों का भौतिक सत्यापन संबंधित जिला आबकारी कार्यालय में किया जाएगा। After allotment, physical verification of original documents will be conducted at the concerned District Excise Office.
• हस्तांतरण निषेध / Non-Transferable: आवंटित लाइसेंस व्यक्तिगत है और विभाग की पूर्व अनुमति के बिना किसी अन्य व्यक्ति को हस्तांतरित नहीं किया जा सकता। The allotted license is personal and cannot be transferred to any other person without prior permission of the Department.

8. रद्दीकरण / अस्वीकृति / Cancellation / Rejection

आवेदन या आवंटन निम्नलिखित आधारों पर रद्द या अस्वीकृत किया जा सकता है:

An application or allotment may be cancelled or rejected on the following grounds:

• गलत जानकारी / False Information: आवेदन में गलत, भ्रामक या मनगढ़ंत जानकारी प्रदान करना। Providing false, misleading, or fabricated information in the application.
• अपूर्ण दस्तावेज / Incomplete Documents: आवश्यक दस्तावेज प्रस्तुत न करना या अपूर्ण दस्तावेज अपलोड करना। Failure to submit required documents or uploading incomplete documents.
• अयोग्यता / Disqualification: राजस्थान आबकारी अधिनियम या नियमों के तहत अयोग्य पाया जाना, जैसे — न्यूनतम आयु पूर्ण न होना, आपराधिक रिकॉर्ड होना, पूर्व लाइसेंस रद्द होना, आदि। Being found ineligible under the Rajasthan Excise Act or Rules, such as — not meeting minimum age requirement, having a criminal record, previous license cancellation, etc.
• भुगतान में चूक / Payment Default: निर्धारित समय-सीमा के भीतर शुल्क का भुगतान न करना। Failure to make fee payment within the prescribed timeline.
• एकाधिक आवेदन / Multiple Applications: एक ही श्रेणी और जिले के लिए एक से अधिक आवेदन प्रस्तुत करना। Submitting more than one application for the same category and district.
• न्यायालय आदेश / Court Order: किसी सक्षम न्यायालय द्वारा जारी आदेश के अनुपालन में। In compliance with an order issued by a competent court.

9. बौद्धिक संपदा / Intellectual Property

इस पोर्टल पर प्रदर्शित सभी सामग्री — जिसमें पाठ्य, ग्राफिक्स, लोगो, चिह्न, चित्र, डेटा संकलन और सॉफ्टवेयर शामिल हैं — आबकारी विभाग, राजस्थान सरकार की बौद्धिक संपदा है और कॉपीराइट कानूनों द्वारा संरक्षित है।

All content displayed on this Portal — including text, graphics, logos, icons, images, data compilations, and software — is the intellectual property of the Excise Department, Government of Rajasthan and is protected by copyright laws.

पोर्टल की सामग्री को विभाग की पूर्व लिखित अनुमति के बिना पुनर्प्रकाशित, पुनर्वितरित या व्यावसायिक उपयोग के लिए कॉपी नहीं किया जा सकता। हालांकि, व्यक्तिगत, गैर-व्यावसायिक संदर्भ के लिए सामग्री का उपयोग स्रोत के उचित श्रेय के साथ किया जा सकता है।

Portal content may not be republished, redistributed, or copied for commercial use without prior written permission of the Department. However, content may be used for personal, non-commercial reference with appropriate attribution to the source.

10. दायित्व की सीमा / Limitation of Liability

आबकारी विभाग, राजस्थान सरकार निम्नलिखित के लिए उत्तरदायी नहीं होगा:

The Excise Department, Government of Rajasthan shall not be liable for the following:

• तकनीकी समस्याएँ / Technical Issues: सर्वर डाउनटाइम, नेटवर्क विफलता, ब्राउज़र असंगतता या अन्य तकनीकी समस्याओं के कारण पोर्टल की अनुपलब्धता या डेटा हानि। Unavailability of the Portal or data loss due to server downtime, network failure, browser incompatibility, or other technical issues.
• भुगतान गेटवे विफलता / Payment Gateway Failures: भुगतान गेटवे की तकनीकी विफलता, लेनदेन विफलता या विलंबित भुगतान प्रसंस्करण। Technical failure of the payment gateway, transaction failures, or delayed payment processing.
• अनधिकृत पहुँच / Unauthorized Access: उपयोगकर्ता की लापरवाही (जैसे पासवर्ड साझा करना) के कारण खाते तक अनधिकृत पहुँच। Unauthorized access to account due to user negligence (such as sharing passwords).
• बाह्य कारक / External Factors: प्राकृतिक आपदा, साइबर हमला, या अन्य अप्रत्याशित घटनाओं (force majeure) के कारण सेवा में व्यवधान। Disruption of service due to natural disaster, cyber attack, or other force majeure events.

विभाग सर्वोत्तम संभव सेवा प्रदान करने का प्रयास करता है, परंतु पोर्टल की निर्बाध या त्रुटि-मुक्त कार्यप्रणाली की गारंटी नहीं देता।

The Department endeavours to provide the best possible service but does not guarantee uninterrupted or error-free operation of the Portal.

11. शासी विधि और क्षेत्राधिकार / Governing Law

ये नियम एवं शर्तें भारतीय कानून द्वारा शासित होती हैं, विशेष रूप से:

These Terms & Conditions are governed by Indian law, specifically:

• राजस्थान आबकारी अधिनियम, 1950 / Rajasthan Excise Act, 1950
• राजस्थान आबकारी नियम, 1956 / Rajasthan Excise Rules, 1956
• सूचना प्रौद्योगिकी अधिनियम, 2000 / Information Technology Act, 2000
• भारतीय संविदा अधिनियम, 1872 / Indian Contract Act, 1872

इन शर्तों से उत्पन्न या संबंधित किसी भी विवाद का निपटारा राजस्थान उच्च न्यायालय, जयपुर पीठ के अनन्य क्षेत्राधिकार में होगा।

Any disputes arising from or relating to these Terms shall be subject to the exclusive jurisdiction of the Rajasthan High Court, Jaipur Bench.

12. संशोधन / Amendments

आबकारी विभाग बिना पूर्व सूचना के किसी भी समय इन नियमों एवं शर्तों में संशोधन, परिवर्तन या अद्यतन करने का अधिकार सुरक्षित रखता है। संशोधित शर्तें पोर्टल पर प्रकाशित होने की तिथि से प्रभावी होंगी।

The Excise Department reserves the right to amend, modify, or update these Terms & Conditions at any time without prior notice. The amended Terms will be effective from the date of their publication on the Portal.

उपयोगकर्ताओं को सलाह दी जाती है कि वे नवीनतम शर्तों से अवगत रहने के लिए समय-समय पर इस पृष्ठ की जाँच करें। संशोधित शर्तों के प्रकाशन के बाद पोर्टल का निरंतर उपयोग संशोधित शर्तों की स्वीकृति माना जाएगा।

Users are advised to check this page periodically to stay informed of the latest Terms. Continued use of the Portal after publication of amended Terms will be deemed acceptance of the amended Terms.
